WHEELING — A restaurant patron is suing AC Buffet and Mongolian Bar-B-Q and related parties, alleging that insufficient measures were taken to prevent customer injuries.
Randall K. Brown of Triadelphia filed a complaint in Ohio Circuit Court against the defendants, alleging that they failed their duty to maintain the premises with reasonable care.
According to the complaint, the plaintiff was walking in the bathroom in the defendant's restaurant on May 31, 2015, when he fell as a result of dangerous and hazardous conditions created by a wet cleaning solution on the surface of the bathroom floor. As a result, Brown claims he suffered physical injuries and lost wages and incurred medical expenses.
The plaintiff holds New AC Buffet LLC and others responsible because the defendants allegedly failed to inspect, repair and maintain the bathroom floor, failed to post signage alerting those who visited the restaurant's bathroom area, failed to warn patrons of the presence of the wet cleaning solution that existed on the surface of the bathroom floor and failed to do all necessary acts to provide for the plaintiff's safety.
The plaintiff requests a trial by jury and seeks judgment for all damages, pre- and post-judgment interest, costs, attorney fees and any other relief. He is represented by James Villanova and Michael Metro of Villanova Law Office P.C. in Pittsburgh.
