WILLIAMSON — A father is suing the Mingo County Board of Education after his daughter was injured on a school bus, alleging negligence and insufficient measures were taken to ensure student safety.
Kevin Johnson filed the complaint in Mingo Circuit Court on behalf of his daughter, Kayden, alleging that the defendant failed its duty to protect and provide safe transportation for all students.
According to the complaint, the plaintiff alleges that Kayden was a passenger of a Mingo County Board of Education School bus on March 1, 2015, when she was shaken and thrown about in her seat due to the bus driver attempting to move the bus off the slippery road. As a result, Kayden suffered physical injuries and pain and was required to seek medical attention. The plaintiff holds the board of education responsible because the defendant allegedly failed to train its bus drivers on how to operate a school bus properly, failed to screen all school drivers and failed to ensure that all students are sitting in safe position when riding the school bus.
The plaintiff requests a trial by jury and seeks judgment in an amount that will fully and fairly compensate the plaintiff for her injuries and damages, plus the cost of this action, pre-judgment interest and other further relief the court deems appropriate.
