LOGAN — A machinist is suing National Armature and Machine Inc., a mine support company, citing alleged disability discrimination, wrongful termination and violation of human rights.
Danny R. Jones filed a complaint on March 1, in the Logan Circuit Court, alleging that the company violated the West Virginia Workers' Compensation Act.
According to the complaint, the plaintiff alleges he was injured on Oct. 24, 2016, while in the course of his normal job duties as a machinist. After the incident, the plaintiff filed a workers' compensation claim and was placed on leave. Shortly after returning to work on Jan. 16, 2017, Jones was laid off while other less experienced employees remained employed. As a result, Jones claims he suffered loss of income and benefits, humiliation and emotional distress. The plaintiff holds National Armature and Machine Inc. responsible because the defendant allegedly failed to give the employee his right for compensatory leave and terminated him based on a disability, either real or perceived.
The plaintiff requests a trial by jury and seeks judgment for compensatory damages, punitive damages, front pay, attorney fees, costs, prejudgment interest and any further relief the court may find appropriate. He is represented by Richard Walters of Shaffer and Shaffer PLLC in Charleston.
