Injured visitor sues hospital, landscaping firm

WHEELING — A husband and wife are suing Ohio Valley Medical Center and a landscaping company, alleging that insufficient measures were taken on the hospital grounds to prevent injuries due to icy conditions.

Gloria Jean Themelaras and Milton Themelaras filed a complaint in Ohio Circuit Court against the defendants, alleging that they failed to provide a safe environment.

According to the complaint, plaintiff Jean Themelaras was visiting her mother at the hospital when she slipped and fell on ice in a walkway near her parked vehicle. She sustained traumatic brain injury, concussion, closed head injury and laceration, the complaint said. The plaintiffs hold Ohio Valley Medical Center Inc. and Ponzani Nuseries LLC responsible because the defendants allegedly permitted the existence of a dangerous, unsafe and hazardous condition to remain in the premises.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, litigation costs, interest and any other relief available under the law. They are represented by Ronald Kasserman of Kasserman Law Offices PLLC in Wheeling.
