BECKLEY — A consumer has filed a class-action lawsuit against Phoenix Financial Services LLC, an Indiana debt collector, alleging unconscionable collection practices.
Ronald Lee Newman, individually and on behalf of all others similarly situated, filed a complaint on March 1, in the U.S. District Court for the Southern District of West Virginia, alleging that the debt collector violated the West Virginia Consumer Credit Protection Act.
According to the complaint, the plaintiff received the initial communication letter from defendant, which was attempting to collect a debt that was beyond the statute of limitations for filing legal action. The plaintiff holds Phoenix Financial Services responsible because the defendant allegedly attempted to collect a time-barred debt and failed to provide disclosure in the initial written communication.
The plaintiff requests a trial by jury and seeks actual and statutory damages, attorney fees and costs and any other appropriate relief. He is represented by Ralph Young, Christopher Frost, Steven Broadwater and Jed Nolan of Hamilton, Burgess Young & Pollard PLLC in Fayetteville.
