Lawsuit accuses telemarketer of harassment

Phone 03

WHEELING — An Ohio County consumer is suing Travel Options Inc., a telemarketer, citing alleged violation of telephone harassment statutes.

Diana Mey filed a complaint March 2 in Ohio Circuit Court against Travel Options Inc., alleging that the telemarketer violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in 2016, she received numerous calls from the defendant about the sale of consumer services. The defendant's action caused her to be annoyed, harassed, bothered and abused, the complaint said. The plaintiff holds Travel Options Inc. responsible because the defendant allegedly willfully engaged in unfair or deceptive conduct by making calls using an autodialer or prerecorded voice and without plaintiff's prior expressed consent.

The plaintiff requests a trial by jury and seeks compensatory, statutory and punitive damages, attorney fees, costs and other just and proper relief. She is represented by Charles Pinkerton of Pinkerton Law Practice PLLC in Morgantown.
