Woman sues motor carrier over husband's death

WHEELING — A spouse is suing commercial motor carrier operator Market Trucking LLC and driver Rickie Samuel, alleging insufficient measures were taken to prevent injuries.

Caren Bachmann, administrator of the estate of her deceased spouse, Bernard Bachmann, filed a complaint March 20 in Ohio Circuit Court against the defendants, alleging that they failed to comply with the applicable commercial trucking safety standards.

According to the complaint, the plaintiff alleges that Bernard Bachmann was wrongfully killed when defendant Samuel, who was operating a freightliner truck owned by defendant Market Trucking, fell asleep, lost control of the truck and struck Bernard Bachmann's vehicle.

Plaintiff Caren Bachmann suffered medical, funeral and burial expenses, lost earnings and loss of service and companionship of her husband. The plaintiff holds Market Trucking LLC and Samuel responsible because the defendants allegedly failed to properly and adequately inspect the truck to ensure that the tires were safe and negligently placed the truck into service even when the treads were excessively worn.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, interest, costs of the court action and such other proper relief. She is represented by Robert Fitzsimmons and Clayton Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling.
