CLARKSBURG — A motorist is suing the U.S. Postal Service over injuries she sustained in a collision with a truck driven by a USPS employee.
Karla Isner filed a complaint March 2 in U.S. District Court for the Northern District of West Virginia against the federal government, alleging that the Postal Service failed to comply with the Federal Tort Claim Act provisions in rejecting Isner's claim.
According to the complaint, the plaintiff alleges that she was severely and permanently injured on Sept. 4, 2014, when a USPS employee, Carrie Phillips, struck her ATV head-on. She filed this complaint within six months of receiving the USPS’s notice of denial of administrative claim, the complaint said. The plaintiff holds the U.S. government responsible because the defendant's employee allegedly failed to operate her vehicle in a lawful and reasonably safe manner and operated her vehicle in excess of the lawful speed limit.
The plaintiff requests a trial by jury and seeks compensatory and general damages, interest, costs, expenses and attorney’ fees and any other equitable relief. She is represented by T. Keith Gould of The Miley Legal Group in Clarksburg.
