Building contractor accused of breach of contract

HUNTINGTON — A husband and wife are suing Grace Contracting LLC, a building contractor, citing defects in a home the company built for the couple.

Larry J. Pittman and Linda Pittman filed a complaint on Feb. 27 in the Cabell Circuit Court against Grace Contracting, alleging that the building contractor violated the West Virginia Code.

According to the complaint, between Aug. 1, 2012, and April 2014, the defendant undertook residential dwelling construction on plaintiffs' property. On July 21, 2015, the plaintiffs discovered cracking and damage to the floor, interior walls and foundation, the complaint said. Due to these defects, mold formed and led to the proliferation of airborne spore particles, rendering the dwelling inhabitable, according to the complaint. The plaintiffs hold Grace Contracting responsible because the defendant allegedly failed to construct the plaintiffs' residence in a professional manner and in compliance with the applicable building codes.

The plaintiffs request a trial by jury and seek compensation for the damages they sustained, punitive damages, costs of this action and other relief. They are represented by W. Stephen Flesher of the Law Offices of W. Stephen Flesher in Barboursville.
