MORGANTOWN — A married couple are suing West Virginia University Medical Corp. and Amedisys West Virginia LLC,, alleging that they took insufficient measures to prevent injuries.
Frank K. Martino and Rina Martino filed a complaint in Monongalia Circuit Court against the defendants, alleging that they deviated form the standards of medical care and treatment.
According to the complaint, plaintiff Frank Martino's pressure injuries continued to deteriorate after a hernia repair. He has suffered pain and suffering, mental anguish, medical expenses and loss of enjoyment of life, the complaint said. Plaintiff Rina Martino allegedly suffered loss of service, society and companionship of her spouse. The plaintiffs hold West Virginia University Medical Corp. and Amedisys West Virginia LLC responsible because the defendants allegedly failed to educate them that plaintiff Frank Martino needed to frequently change positions and failed to properly monitor and treat his pressure ulcer after his release from a hospital.
The plaintiffs request a trial by jury and seek compensatory and punitive damages, interest, litigation costs and other appropriate relief. They are represented by Jacques R. Williams and Brianna W. McCardle of Hamstead, Williams & Shook PLLC in Morgantown.
