Cabell Co. man sues East of Chicago Pizza for hair in pizza

HUNTINGTON – A Cabell County man is suing East of Chicago Pizza after he claims there were hairs cooked into his pizza.

On July 10, 2015, Timothy Morris purchase a pizza from East of Chicago Pizza in Barboursville, according to a complaint filed in Cabell Circuit Court.

Morris claims unbeknownst to him, one or more employees cooked hair, which appeared to be pubic hair, into the pizza underneath the cheese toppings.

The plaintiff returned home with the pizza, not knowing that it was contaminated and unknowingly consumed a portion of the contaminated pizza that evening, according to the suit.

Morris claims after eating the pizza, he experienced nausea and stomach sickness, which lasted the entire night.

The following day, Morris discovered the hair in the pizza the following morning when he went to clean up the pizza box and the leftover pizza, according to the suit.

Morris claims he filed a police report with the Cabell County Sheriff’s Department, where it remains under the Sheriff’s Department’s control and custody.

East of Chicago Pizza owes a duty to the public and owed a duty to Morris to conduct its business in a way as to not create unreasonable risk of harm to its customers, according to the suit.

Morris claims East of Chicago Pizza breached its duties by selling and delivering to him a pizza contaminated with what appeared to be pubic hair.

The plaintiff has been damaged as a result of the defendant’s conduct, according to the suit.

Morris is seeking compensatory and punitive damages. He is being represented by Ryan Q. Ashworth and S. Taylor Hood of Offutt Nord Burchett.

The case is assigned to Circuit Judge Paul T. Farrell.
