Man sues Smiley's, Americas Best Value Inn for injuries from assault

CHARLESTON – A man is suing a bar and an adjoining motel after he claims he was assaulted on its premises.

Smiley’s Inc. was also named as a defendant in the suit. The bar/restaurant is located in the Americas Best Value Inn motel.

On March 13, 2015, Douglas Reynolds was staying at the Americas Best Value Inn motel for work, and was inside Smiley’s watching a basketball game on the television, according to a complaint filed March 8 in Kanawha Circuit Court.

Reynolds claims at approximately 1 a.m., he was leaving Smiley’s to return to his motel room when he was brutally attacked by two patrons of Smiley’s.

When a co-worker of Reynolds’ came outside to return his cell phone that he’d left inside the Smiley’s, he found him on the ground, being kicked by the two patrons, according to the suit.

Reynolds claims the two patrons fled the scene and were never apprehended by the police.

As a result of the violent attack, Reynolds sustained serious bodily injury, some of which is permanent in nature, according to the suit.

Reynolds claims the defendants were negligent and owed a duty of care to keep its premises in a reasonably safe condition and to protect invitees.

The defendants’ actions were negligent, careless and reckless and caused Reynolds to sustain serious injuries and incur medical expenses and other damages, including lost wages.

Reynolds is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Russell A. Williams of Pritt Spano & Williams.

The case is assigned to Circuit Judge Carrie Webster.
