On Feb. 25, 2015, Tonya Faye Vance was serving as a volunteer concession worker at a Tug Valley High School sporting event when she slipped and fell on an icy rubber conveyor belt covering a section of a damaged walkway on the school’s campus, according to a complaint filed March 3 in Mingo Circuit Court.
Tonya Vance and Jeffrey Dwayne Vance claim the board had a duty to exercise due care and reasonable precaution in maintaining the safety of campus walkways.
The board breached its duty of care and reasonable precaution by negligently using a rubber conveyor belt to cover a section of a damaged campus walkway and failed to timely repair the walkway, according to the suit.
The Vances claim the defendant also failed to timely remove snow and icy debris from the walkway and failed to identify and prevent the foreseeable risks of a known campus walkway hazard, which caused the incident.
Tonya Vance sustained serious and permanent bodily injuries as a result of the defendant’s negligence, according to the suit.
The Vances claim she also experienced mental anguish as a result of the incident.
Jeffrey Vance sustained a loss of consortium as a result of the negligence, according to the suit.
The Vances are seeking compensatory damages. They are being represented by Jeffrey S. Simpkins of Simpkins Law Office.
