Sales manager accuses funeral home of age discrimination

WINFIELD — A Hurricane man is suing a funeral business, alleging violation of state law.

Gregory D. McFarland filed a complaint March 9 in Putnam Circuit Court against SCI West Virginia Funeral Services Inc., alleging the defendant wrongfully terminated his employment because of his age, which is 62.

According to the complaint, as a result of the defendant's discriminatory conduct, McFarland has suffered lost wages and benefits, loss of dignity, emotional and mental distress after he was terminated from his employment Oct. 27, 2016, The suit says the dismissal took place approximately four months after McFarland received the top sales leader award.  

The plaintiff alleges the defendant made his job performance impractical and impossible to achieve.

McFarland seeks trial by jury, compensatory and punitive damages, attorney fees, court costs and interest and all other just and proper relief. He is represented by attorney Thomas H. Peyton of Peyton Law Firm PLLC in Nitro.
