Wyoming County homebuyers allege bank violated law

PINEVILLE — Two Wyoming County homebuyers are suing a bank, alleging fraudulent misrepresentation and inducement.

Randall T. Cook and Sharon M. Cook filed a complaint in Wyoming Circuit Court against Logan Bank & Trust Company alleging violation of the plaintiffs' trust and interest.

According to the complaint, on June 2, 2010, the Cooks entered into a contract with Logan Bank & Trust to purchase a home and property on a 2.43-acre lot in Ocena. On March 12, 2015, the suit says, they returned to Logan Bank to refinance the property but learned that the defendant made false representations.

As a result of, the lawsuit states, the Cooks have suffered financial losses, diminished value of property and have been annoyed and inconvenienced. The plaintiffs allege Logan Bank & Trust made multiple incorrect representations that the property was not in a flood zone area and advised them that they did not need to purchase flood insurance.

The Cooks seek trial by jury, rescission of the mortgage contract, judgment for all the payments made for the purchase of the property, punitive damages, interest, costs of court and all other relief. They are represented by attorneys William R. Wooton and Melissa R. Lyons of Wooton & Wooton in Beckley.
