MOUNDSVILLE — A Wheeling man is suing an insurance company, alleging wrongful refusal to apply payments for his claims of coverage under a policy.
Benjamin J. Schneider filed a complaint March 13 in Marshall Circuit Court against State Auto Property and Casualty Insurance Company, alleging failure to follow a written policy agreement.
According to the complaint, on March 13, 2015, Schneider sustained injuries when his vehicle was struck from behind in Moundsville by another vehicle operated by Austin B. Yannerella. The suit says Schneider received $20,000 from the Yannerella's insurance company as payment for the damages sustained but the plaintiff has failed to recover his claim for under-insured motorists benefits coverage.
The plaintiff alleges State Auto failed to uphold the written policy contract agreed to with Schneider and failed to pay the plaintiff his claims to recover under-insured motorist benefits.
Schneider seeks trial by jury, judgment to be determined by a jury, attorney fees, court costs, pre and post-judgment interest and all other appropriate relief. He is represented by attorney Christopher M. Turak of Gold, Khoukey and Turak, LC in Moundsville.
