MORGANTOWN — A Morgantown couple is suing an insurance underwriter, alleging breach of contract, negligent misrepresentation and unjust enrichment.
Christine Witthohn and Jeffrey V. Mehalic filed a complaint March 14 in Monongalia Circuit Court against Highmark West Virginia Inc. alleging breach of covenant of good faith and fair dealing.
According to the complaint, as a result the cancellation of their coverage, Witthohn and Mehalic were forced to pay medical bills in excess of $43,000. The plaintiffs allege Highmark West Virginia paid them smaller claims and prescriptions while denying claims for larger amounts incurred between December 2016 and January 2017 and refused to reinstate their coverage for the same period.
The plaintiffs seek compensatory and punitive damages, interest, costs of court and an order declaring the Balance Blue PPO 750 and Connect Blue PPO 1500G policies provide coverage to them, plus all just and proper relief. They are self-represented by Mehalic of Law Offices of Jeffrey V. Mehalic in Morgantown.
