WILLIAMSON — A Gilbert couple is suing an automobile distributor, alleging breach of express and implied warranties.
Rocky Kennedy and Betty Kennedy filed a complaint March 22 in Mingo Circuit Court against FCA US LLC, doing business as Chrysler CT Corp. System, alleging failure to comply with the Lemon Law.
According to the complaint, on Sept. 7, 2013, the Kennedys purchased a 2013 Dodge Ram 500 Truck from the defendant's authorized dealer. Thereafter, the suit says, the plaintiffs learned of the vehicle's defective condition.
The defective condition of the vehicle is likely to cause injuries and/or death, the lawsuit states. The plaintiffs allege Chrysler failed to repair the vehicle in a good and workmanlike manner so as to bring it into conformity with applicable warranties.
The Kennedys seek trial by jury, damages up to $75,000, attorney fees and court costs, plus all equitable relief. They are represented by attorney Greg K. Smith of Law Office of Greg K. Smith in Williamson.
