BECKLEY — A vehicle passenger from Raleigh County is suing a motorist and an insurance company, alleging negligence and breach of contract.
Dreama Kay McIntosh of Daniels filed a complaint March 22 in Raleigh Circuit Court against John Doe, a motorist, and National General Insurance Company, alleging Doe failed to use reasonable care and caution for the safety of others while driving.
According to the complaint, on March 28, 2015, McIntosh was a passenger in the vehicle operated by Amanda Cochran when the vehicle was rear-ended in Raleigh County. At the time of the accident, the suit says, Cochran's vehicle was under bodily injury uninsured motorist coverage, and McIntosh seeks compensation for damages caused.
McIntosh alleges she suffered physical injuries, pain and incurred medical expenses.
The plaintiff alleges John Doe failed to stop during the incident and maliciously left the scene of the wreck without stopping, failed to look out for other motorists in the public roadway, while National General Insurance has failed to compensate McIntosh for her damages as required by her insurance coverage.
McIntosh seeks trial by jury, compensatory and punitive damages, attorney fees, litigation costs, pre- and post-judgement interest and all just relief. She is represented by attorney Anthony M. Salvatore of Hewitt and Salvatore PLLC in Fayetteville.
