Mining equipment, parts supplier alleges buyer failed to pay $718,000

WHEELING — A Wheeling mining equipment and parts supplier is suing a buyer, alleging failure to pay for purchased products.

R.M. Wilson Co. Inc. filed a complaint March 22 in Ohio Circuit Court against ERP Compliant Fuels LLC, alleging failure to perform its contractual obligations.

According to the complaint, R.M. Wilson supplied mining equipment to Complaint Fuels. Since Nov. 3, 2016, the suit says, $718,574.56 remains due and owing. The plaintiff alleges ERP Compliant Fuels has failed to make payments for the said amount.

R.M. Wilson seeks trial by jury, judgment in the amount of $718,574.56, plus interest, attorney fees, court costs and all other just and equitable relief. He is represented by attorney Frank X. Duff of Schrader Byrd & Companion PLLC in Wheeling.
