Motorist blames driver, employer for crash

LOGAN — A Logan County motorist is suing a Charleston trucking business and driver, alleging their negligence caused a crash. 

Luther Dalton of Chapmanville filed a complaint March 23 in Logan Circuit Court against Daniel Kelley and J&E Trucking Inc. alleging J&E Trucking negligently trained Kelley in the proper operation of the vehicle he was driving.

According to the complaint, on Feb. 17, Dalton was driving his 2004 Chevrolet Cavalier on state Route 73 in Logan County and was stopped at a traffic light at the intersection of Fountain Place Mall. The suit says Kelley, who was operating a truck while under the employment of J&E Trucking, violently crashed into the rear of Dalton's vehicle. 

The lawsuit states Dalton has suffered property damage, personal injuries, emotional distress, lost wages and medical expenses. The plaintiff alleges Kelley failed to maintain proper control of his vehicle and failed to keep a careful lookout.

Dalton seeks trial by jury, compensatory and exemplary damages, plus interest, costs of court and all further relief. He is represented by attorney Robert B. Kuenzel of Kuenzel Law PLLC in Chapmanville.
