Propery owner alleges tenants failed to pay

BECKLEY — A Beckley property owner is suing tenants, alleging breach of a lease agreement.

Morgan Land Development LLC filed a complaint March 24 in Raleigh Circuit Court against Personal Touch Physical Therapy LLC and Shannon Brooks, alleging they failed to perform obligations under the contract.

According to the complaint, on Nov. 15, 2016, Morgan Land purchased certain Beckley properties from A.J. Enterprises. Prior to the purchase, the suit says, Personal Touch, entered into a lease agreement with A.J. Enterprises, in which it would lease one of the Beckley properties for $2,250 for three years. 

Since Feb. 1, 2017, the suit says, Morgan Land has not receive any rent due under the lease. The plaintiff alleges the defendants remain in default since Feb. 1, improperly removed items from the premises and failed to properly maintain the premises.

Morgan Land Development seeks trial by jury, all amounts rightfully owed the plaintiff, all damages, plus interest, attorney fees, court costs and expenses. It is represented by attorney Gavin G. Ward of Ward Law Office PLLC in Beckley.
