HUNTINGTON — A disabled employee is suing a benefits plan administrator, alleging violation of workers compensation acts.

Benjamin S. Miller of Parkersburg filed a complaint March 24 in U.S. District Court for the Southern District of West Virginia against Unum Life Insurance Company of North America, alleging violation of the Employment and Retirement Income Security Act.

According to the complaint, as a result of the defendant's actions, Miller has suffered damages for not receiving long-term disability benefits despite medical evidence demonstrating his qualifications for the benefits. The plaintiff alleges Unum Life has unlawfully denied his request and appeal for LTD benefits that are due to him under the insurance policy.

Miller seeks trial by jury, past and present disability benefits, plus interest, attorney fees and couort costs and any other appropriate relief. He is represented by attorneys Kenneth P. Hicks and D. Geoffrey Varney of Kenneth P. Hicks LC in Huntington.
