Couple blames city of Weirton driver for injuries

NEW CUMBERLAND — A Weirton couple is suing the city and one of its employees, alleging their negligence caused a vehicle crash.

Louis Krista and Joann Krista filed a complaint on March 27, in the Hancock Circuit Court against Michael Orlando and the city of Weirton, alleging negligence and failure to properly upkeep and maintain Marland Heights Road.

According to the complaint, on Sept. 29, 2016, Louis Krista was operating a motor vehicle on Marland Heights Road, in which Joann Krista was a passenger. Suddenly, the suit says, Orlando violently struck their vehicle with great force. 

The lawsuit states both plaintiff sustained severe injuries that resulted in physical and mental pain, medical expenses, disability and lost wages. The plaintiffs allege Orlando carelessly and recklessly operated his motor vehicle and that the city of Weirton failed to properly maintain Marland Heights Road.

The Kristas seek trial by jury, all damages, plus interest and costs of court, and all other general and special relief. They are represented by attorneys M. Eric Frankovitch and Kevin M. Pearl of Frankovitch, Anetakis, Simon, DeCapio & Pearl LLP in Weirton.
