Mother blames, doctors, medical facility for son's injuries

CHARLESTON — A Kanawha County woman is suing medical professionals, alleging a negligent medical procedure resulting in permanent injuries to her son.

Demetria Shafi, parent and guardian of Amir Miguel Shafi, filed a complaint March 29 in Kanawha Circuit Court against Dr. Allen, Krajeklan, Brock and Hunsaker Inc. doing business as Mountain State Oral and Maxillofacial Surgeons, Dr. Franklin Allen IV, et al, alleging they failed to detect the correct operation to be done on the patient to avoid further injuries.

According to the complaint, on Jan. 19, 2015, Amir Miguel Shafi was taken to MSOMS and diagnosed with having a large cystic neoplasm. After a required CT scan, the suit says, an attempt to remove a tooth was not successful due to an extensive rush of blood, 

The lawsuit says Shafi was transferred to Cincinnati Children's Hospital to undergo another surgery where he sustained respiratory failure following trauma and surgery, an acute ischemic left MCA stroke and bleeding. He has been left with aphasia and right hemiparesis, the suit says. 

Demetria Shafi says she has suffered loss of earning capacity, medical expenses and mental anguish. 

The plaintiff alleges the defendants failed to properly and adequately evaluate the cyst or tumor of Amir Miguel Shafi leading to permanent and severe neurological disability.

Demetria Shafit seeks trial by jury, compensatory and punitive damages, pre and post-judgment interest and all other appropriate relief. She is represented by attorney Richard D. Lindsay of Tabor Lindsay and Associates in Charleston.
