CHARLESTON — A 58-year-old Wirt County man is suing a Kanawha County water works business, alleging age discrimination.
Jeff Miller filed a complaint March 30 in Kanawha Circuit Court against American Water Works Services Co. Inc., American Water Works Co. Inc., West Virginia-American Water Co. and Jeff McIntire, alleging they violated the West Virginia Human Rights Act.
According to the complaint, on Feb. 1, Miller applied for superintendent II position for which he is qualified. As a result of the denial of his application, the suit says, he has suffered lost wages and benefits, indignity, embarrassment and humiliation.
The plaintiff alleges the defendants denied to give him the position he was applying for. Instead, the suit says, it was given to a much younger applicant.
Miller seeks trial by jury, all damages, pre- and post-judgment interest, attorney fees and court costs and all just and equitable relief. He is represented by attorney Mark A. Atkinson of Atkinson & Polak PLLC in Charleston.
