Employee accuses health care facility of discrimination

CHARLESTON — A Kanawha County man is suing a health care facility, alleging discrimination, retaliation and wrongful discharge.

Jason B. Waugh filed a complaint March 31 in Kanawha Circuit Court against Sunbridge Dunbar Health Care LLC, doing business as Dunbar Center, alleging violation of the West Virginia Code.

According to the complaint, on Oct. 14, 2015, Waugh, who had worked for Dunbar Center since 2010, was injured on the job. Subsequently, the suit says, he filed a workers' compensation claim, for which he was entitled to receive. 

On March 3, 2016, Waugh says he was terminated from his employment for filing the workers' compensation claim. The plaintiff alleges the defendant has discriminated and retaliated against him by terminating his employment for attempting to receive workers' compensation benefits.

Waugh seeks trial by jury, compensatory and punitive damages, attorney fees and court costs and all other equitable relief. He is represented by attorneys J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston,  and by G. Patrick Jacobs of Jacobs Law Offices in Charleston.
