Exterminator blames recycling business for injuries

NEW MARTINSVILLE — An Ohio exterminator is suing a recycling business, alleging its negligence led to injuries for the plaintiff. 

Mike J. Elerick of St. Clairsville, Ohio, filed a complaint March 31 in Wetzel Circuit Court against ZWO Recycling LLC, alleging the defendant breached its duty to maintain its premises reasonably safe.

According to the complaint, on April 4, 2015, Elerick was performing extermination services at ZWO Recycling in New Martinsville when he tripped and fell over a ladder placed on the floor. The suit says Elerick sustained severe injuries to his back, hip and leg that caused him to incur substantial medical expenses. 

The plaintiff alleges ZWO Recycling breached its duty to protect Elerick and other similarly situated individuals.

Elerick seeks trial by jury, compensatory damages, court costs and all other proper relief. He is represented by attorney Don A. Yannerella of Wheeling.
