Father blames urologic surgeon for child's injuries

Medical malpractice 08

CHARLESTON — The parent of a Logan County patient is suing a urologic surgeon, alleging his negligence caused injuries to a young child.

WJK, by his parent and next friend William Kirk, filed a complaint April 3 in Kanawha Circuit Court against Dr. Rodney Dean, alleging failure to provide services in accordance with the appropriate standard of medical care.

According to the complaint, as a result of Dean's negligence, the 1-year-old WJK had to undergo a second, subsequent surgery to repair his hypospadias. As a result, the suit says, WJK had to suffer pain and costs associated with the subsequent surgery.

The plaintiff alleges Dean failed to recommend a pediatric urologist for WJK's surgical procedure and failed to exercise the degree of care expected of a prudent health care provider.

Kirk seeks trial by jury, compensatory damages, interest and all other just and proper relief. He is represented by attorneys Robert B. Kuenzel and James A. Mead of Kuenzel Law PLLC in Chapmanville, and by attorney Donald C. Wandling of Wandling Law Office LC in Logan.
