Moundsville property owner accuses contractors of negligence

MOUNDSVILLE — A Moundsville property owner is suing contractors, alleging their negligence led to a landslide on his property.

Donald Gump filed a complaint April 3 in Marshall Circuit Court against J.F. Allen Company and John Doe Corp., alleging they negligently performed modifications on an adjacent property.

According to the complaint, on April 10, 2015, Gump suffered a landslide of debris on his property that caused damages. The suit says Gump also has suffered economic loss, emotional distress, annoyance and inconvenience. 

The plaintiff alleges the defendants negligently designed, constructed and maintained the property adjacent to Gump's property and negligently caused the redirection of water, debris and other matters onto and over his property at 1698 Frontage Drive, Moundsville.

Gump seeks trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees, court costs and all other just and appropriate relief. He is represented by attorney David A. Jividen of Jividen Law Offices PLLC in Wheeling.
