Subcontractor alleges mining company, property owners owe more than $33,000

BECKLEY — A Kanawha County subcontractor is suing a Putnam County mining company and property owners, alleging they owe more than $33,000 for breach of agreement and unjust enrichment.

Virco Contracting Inc. filed a complaint April 3 in Raleigh Circuit Court against Revelation Energy LLC, Acin LLC et al and Rowland Land Company LLC, alleging they failed to fulfill their contractual obligations.

According to the complaint, pursuant to a subcontract with Revelation, Virco Contracting provided labor and materials necessary for the reclamation of Revelation's mining activities for $33,350. To date, the suit says, the plaintiff has not received any payment from the defendant. 

Virco Contracting seeks trial by jury, judgment, jointly and severally for the full amount of $33,350, attorney fees, court costs and all other just and proper relief. It is represented by attorney Scott H. Kaminski of Kaminski Law PLLC in Charleston.
