NEW CUMBERLAND — An Ohio patron is suing a Hancock County casino, alleging breach of contract and that insufficient measures were taken to prevent monetary damages.
Gregory Spatholt filed a complaint April 5 in Hancock Circuit Court against Certegy Check Services Inc. and Mountaineer Park Inc., alleging the casino operators breached their duty to safeguard the plaintiff's account.
According to the complaint, as a result of the defendants negligence, Spatholt, who alleges he had the casino's permission to cash personal checks, lost $10,922.20, incurred attorney fees of more than $4,300, lost use of his money and suffered annoyance, anxiety and emotional distress.
The plaintiff alleges the defendants permitted an unauthorized person to cash checks on Spatholt's account.
Spatholt seeks trial by jury, compensatory and punitive damages, attorney fees and court costs and all other just and proper relief. He is represented by attorney Lawrence Manypenny of New Cumberland.
