Motorcyclist, passenger accuse truck driver of negligence

FAYETTEVILLE — A Fayette County motorcycle driver and his passenger are suing a truck driver, alleging negligence while driving on a public roadway and causing serious injuries.

Vincent T. Carte and Shelia Carte filed a complaint April 11 in Fayette Circuit Court against Daryl S. Carte of Hico, alleging the defendant failed his duty to use reasonable care and caution while driving for the safety of others.

According to the complaint, on April 12, 2015,  Vincent T. Carte was operating a motorcycle with Shelia Carter as passenger when they collided with the Daryl Carte's Ford Ranger truck on Sunday Road in Hico. As a result, the suit says, the plaintiffs suffered physical injuries and incurred medical expenses of more than $19,500.. 

The plaintiffs allege the defendant failed to keep proper lookout, failed to reduce speed and failed to keep his motor vehicle under proper control.

The Cartes seeks trial by jury, judgment justified by the evidence and all other relief the court deems just and proper. They are represented by attorney Anthony M. Salvatore of Hewitt and Salvatore, PLLC in Fayetteville.
