Daughter accuses health care providers of wrongful death

CHARLESTON — A daughter is suing Kanawha County health care providers, alleging medical negligence and wrongful death.

Carol O'Neal Haid, executor of the estate of Maxine F. O'Neal, deceased, filed a complaint April 7 in Kanawha Circuit Court against 1000 Association Drive Operation LLC doing business as Oak Ridge Center, Genesis Healthcare, et al, alleging they breached their duty of providing the standards of care in the treatment of the plaintiff's decedent.

According to the complaint, after Maxine O'Neal was admitted at Oak Ridge Center, she suffered multiple un-witnessed falls, acute renal failure, wound infection, dehydration and malnourishment. She suffered septic shock and passed away Dec. 11, 2014, the suit says. 

As a result of her death, the lawsuit states, O'Neal's family, including the plaintiff, suffered sorrow, loss of society, comfort and guidance. The plaintiff alleges the defendants failed to timely examine, diagnose, treat and monitor O'Neal's medical condition.

Haid seeks trial by jury, compensatory and punitive damages, plus interest and court costs and all such other just and proper relief. She is represented by attorney Edward G. Atkins of John R. Mitchell LC in Charleston.
