Estate executrix accuses WVU Board of Governors of negligence

CHARLESTON — An estate executrix is suing the West Virginia University Board of Governors for allegedly taking insufficient measures to prevent injuries.

Robin Ragsdale, individually and as executrix of the estate of Tommy Ragsdale, filed a complaint in Kanawha Circuit Court, alleging that the defendant violated the West Virginia Medical Professional Liability Act.

According to the complaint, the plaintiff alleges that Tommy Ragsdale died on Dec. 12, 2013 from sepsis, hypotension and anastomotic leak as a result of defendant's negligence. Robin Ragsdale claims that she has suffered loss of society, comfort and the guidance of the decedent. The plaintiff holds the defendant responsible for allegedly breaching its duty to provide reasonable care and treatment to Tommy Ragsdale and deviating from the level of care exercised by other health care providers.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages plus interest, attorney's fees, costs and expenses and other relief. She is represented by Timothy D. Houston of Houston Law PLLC in Charleston and Kathy A. Brown of Kathy Brown Law PLLC in Charleston.
