Clarks Tree Service accused of taking insufficient measures to prevent injuries

WINFIELD — A motorist has filed a class-action lawsuit against Johnny Ray Matheny and Clarks Tree Service LLP for allegedly taking insufficient measures to prevent injuries.

Jonathan Hill filed a complaint in Putnam Circuit Court against the defendants alleging that Matheny filed to maintain proper control of his service vehicle.

According to the complaint, the plaintiff alleges that he was lawfully driving a motor vehicle on April 13, 2015. Hill claims that as he began to turn left, Matheny, who was driving a vehicle owned by Clarks Tree Service, negligently crashed into the rear of the plaintiff's vehicle. The plaintiff sustained injuries that caused him to suffer physical and mental pain, medical expenses and lost wages. Matheny was allegedly driving with a revoked license. The plaintiff holds the defendants responsible for allegedly failing to keep a careful lookout, stop or take evasive actions to avoid the collision.

The plaintiff requests a trial by jury and seeks actual and compensatory damages, attorney fees, costs and interest and such other appropriate relief. He is represented by Charles R. "Rusty" Webb of The Webb Law Center PLLC in Charleston.
