Homeowner alleges lenders failed to explain loan terms

WAYNE — A Wayne County homeowner is suing national lenders, alleging unconscionable inducement.

Crystal Nance filed a complaint April 10 in Wayne Circuit Court against Citifinancial Inc., Bayview Loan Servicing LLC and John Doe Holder, alleging they failed to explain the terms of a loan.

According to the complaint, as a result of the defendants' conduct, Nance, who says she is "unsophisticated in mortgage and financial matters," has suffered worry, stress, inconvenience and fear of losing her home. 

The plaintiff alleges the defendants induced and persuaded her into repeated refinancing agreements secured by her home in amounts that exceeded her capacity to pay and that they failed and refused to properly apply Nance's payment on her mortgage account.

Nance seeks trial by jury, actual damages, plus penalties, attorney fees, court costs and all other just and equitable relief. She is represented by attorney Daniel P. Lattanzi of Pepper & Nason in Charleston.
