Estate executor blames nursing home facility operators for resident's death

BECKLEY — An estate executor is suing Raleigh County nursing home facility operators, alleging their negligence led to the death of a resident. 

Edward William Smith of Falls Church, as executor of the estate of George William Smith, filed a complaint April 11 in Raleigh Circuit Court against Saddle Shop Road Operations LLC, doing business as Hilltop Center, Genesis Healthcare Corp. and Brian Chapman, alleging violation of the Nursing Home Act.

According to the complaint, between June 3, 2015 and Aug. 22, 2015, George Smith was a resident at Hilltop Center. During his residency, the suit says, he sustained serious injuries and was caused to suffer significant destruction to his physical condition that eventually led to his death Nov. 7, 2015. 

The plaintiff alleges the defendants were negligent in failing to provide appropriate and adequate health care and protective support services.

Edward Smith seeks trial by jury all damages allowed under West Virginia laws, attorney fees, court costs and legal expenses. He is represented by attorneys Damon Ellis and Jonathan R. Mani of Mani Ellis & Layne PLLC in Charleston.
