Patient blames medical provider for unnecessary surgery

BECKLEY — A Raleigh County patient is suing a medical provider, alleging medical negligence. 

Pearl Hughes filed a complaint April 12 in Raleigh Circuit Court against Dr. John Tabit, alleging the defendant negligently deviated from the appropriate standard of medical care.

According to the complaint, as a result of Tabit's negligence, Hughes was exposed to unnecessary surgery and medical expenses. She says she has suffered monetary damages and had to endure pain and suffering, mental anguish and a decrease in her ability to function independently. 

The plaintiff alleges Tabit failed to obtain an X-ray on Hughes' left hip prior to performing a procedure that was unnecessary and inappropriate.

Hughes seeks trial by jury, damages that will adequately compensate plaintiff for her damages and all other just and proper relief. She is represented by attorneys Robert V. Berthold and Holly G. Dicoco of Berthold Law Firm PLLC in Charleston.
