RIPLEY — A California corporation is suing a debtor and guarantor, alleging breach of contract and unjust enrichment.
BakerCorp of Seal Beach, California, filed a complaint April 17 in Jackson Circuit Court against Pete Gould & Sons Inc. and James Gould, alleging failure to fulfill their obligations under the terms of a contract.
According to the complaint, in September 2016, BakerCorp leased industrial equipment to the defendants. Subsequently, the suit says, the plaintiff has remitted several invoices for the leased equipment totaling $94,519.82. To date, the lawsuit states, the invoices remain unpaid and is 60 to 120 days past due.
BakerCorp seeks trial by jury, compensation for the $94,519.82 due, pre- and post-judgment interest and all other just and fair relief. It is represented by attorney Lance E. Rollo of Morgantown.
