WHEELING — An Ohio County couple is suing a property seller and mortgage loan provider, alleging breach of contract and fraud.
Christopher Schultz and Kayla Schultz filed a complaint April 13, in the Ohio Circuit Court against Shane Shaffer, Kari Shaffer, Wilson Appraisal Service Inc., Union Home Mortgage Corp. et al, alleging the defendants failed to disclose the true condition of the Schultzes' home.
According to the complaint, on March 21, 2014, the Schultzes purchased a home in Wheeling from the Shane and Kari Shaffer for the purchase price of $115,000. The suit says the plaintiffs also obtained a mortgage for the home through Union Home Mortgage Corp. with an approved loan of $112,917, relying on Union Home's inspections that the property was in good condition.
After closing the property, the lawsuit states, the Schultzes say they have discovered that the home's condition is not safe due to plumbing issues, inadequate drainage, defected flooring and other problems.
The plaintiffs allege the defendants failed to disclose the true condition of the house that created a dangerous environment and rendered the home uninhabitable, concealed material defects of the home and continued the contract by loaning the plaintiffs monies to purchase a home that was uninhabitable.
The Schultzes seek trial by jury, compensatory and punitive damages, plus interest, court costs and fees and all other appropriate relief. They are represented by attorneys Paul J. Harris and Gregory A. Gaudino of Petroplus and Gaudino PLLC in Wheeling.
