Ex-employee alleges companies failed to pay proper wages

NEW CUMBERLAND — A Weirton man is suing his former employers, alleging breach of an employment agreement.

Daniel P. Frankovitch filed a complaint April 19 in Hancock Circuit Court against AllFuel Services Company Inc. Pozo Services Corporation, Robert Ragland and Mark Buis, alleging they violated the West Virginia Wage Payment Collection Act.

According to the complaint, as a result of the defendants' breach of contract, Frankovitch suffered damages, including lost wages and employment benefits. The plaintiff alleges the defendants failed and refused to pay the plaintiff's final wages wages within the required period mandated by WVWPCA.

Frankovitch seeks trial by jury, actual and punitive damages, costs of court, attorney fees and all other just and equitable relief. He is represented by attorney Carl A. Frankovitch of Frankovitch, Anetakis, Simon, Decapio & Pearl LLP in Weirton.
