LOGAN — A Logan County man is suing his former employer, alleging disability discrimination.
Daniel Lester filed a complaint on April 19, in the Logan Circuit Court against Asplundh Tree Expert Co. alleging violation of the West Virginia Human Rights Act.
According to the complaint, on Jan. 8, 2016, Asplundh Tree Expert refused to allow Lester to return to work after he had been injured on the job. As a result, Lester says he has suffered lost wages and employment benefits, embarrassment and emotional distress.
The plaintiff alleges Asplundh Tree Expert refused to provide reasonable accommodations and discriminated and retaliated against Lester by terminating his employment for seeking workers' compensation benefits.
Lester seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees and court costs and all other just and equitable relief. He is represented by attorney Steven S. Wolfe of Wolfe, White & Associates in Logan.
