Customer accuses finance company of collection violations

LOGAN — A Logan County woman is suing a financial company, alleging misrepresentation in debt collection.

Pearl Cresong filed a complaint in Logan Circuit Court against Cascade Capital, LLC, alleging violation of the West Virginia Consumer Credit and Protection Act.

According to the complaint, on April 14, 2015, Cascade Capital filed a civil complaint against Cresong in the magistrate court of Logan County on an allege consumer debt of $1,854.30, plus interest of $85. 

Cresong says the complaint failed to include the date and amount of payments made on the account and no accurate reflection of the actual amount of principal and interest. 

As a result, Cresong says, she suffered emotional distress, inconvenience and embarrassment. 

The plaintiff alleges Cascade Capital failed to account for the actual amount owed, failed to break down the required amount owed between principle and interest, and failed to show in the magistrate court complaint the last payment made by the plaintiff.

Cresong seeks trial by jury, actual and statutory damages, cost of litigation including attorney fees, court costs and all other proper and appropriate relief. She is represented by attorney Steven S. Wolfe of Wolfe, White and Associates in Logan.
