LOGAN – Another lawsuit has been filed against Bizzack Construction for property damages caused by highway construction, bringing the total to more than 20 lawsuits.
Mary V. Conner claims between June 2014 and June 2016, her real property began experiencing cracks and subsidence that had not existed prior to the blasting done by the defendant, according to a complaint filed in Logan Circuit Court.
Conner claims Bizzack began blasting bedrock near her property in the process of constructing a highway, and that was when her property was damaged.
The defendant continues the activity to this day, according to the suit.
Conner claims the blasting was and is an abnormally dangerous activity and the defendant is liable for any and all damages to her property caused by or resulting from the blasting.
The plaintiff’s damages and continuing damages are a direct and proximate result of the defendant’s abnormally dangerous activity, according to the suit.
Conner claims as a direct and proximate result of the defendant’s actions, she has incurred and will continue to incur damages to her homes and real property; a decrease in the value of her property; expenses for repairing her home and property; substantial annoyance and inconvenience; and the loss of use and enjoyment of her home and property.
Conner is seeking compensatory and punitive damages. She is being represented by John H. Skaggs of the Calwell Practice; and G. Patrick Jacobs of the Law Office of G. Patrick Jacobs.
At least 23 lawsuits have been filed against Bizzack for property damage due to the highway construction in Logan Circuit Court.
