Barbour County property owners allege mortgage loan service broke law

PHILIPPI — Two Barbour County property owners are suing a mortgage loan business, alleging unconscionable collection practices.

Barbara A. Gillis and Elizabeth Moats filed a complaint April 3 in Barbour Circuit Court against Bayview Loan Servicing LLC, alleging violation of the West Virginia Consumer Credit and Protection Act.

According to the complaint, Gillis and Moats, who say the have limited knowledge of financial matters, suffered annoyance, anxiety, inconvenience and fear of losing their home in Philippi. The plaintiffs allege Bayview Loan induced them to accept a predatory loan, misrepresented the amounts the plaintiffs owed, unlawfully added excessive late charges and is engaging in foreclosing the plaintiffs' home.

The plaintiffs seek trial by jury, actual damages, attorney fees, costs of litigation and all other just and equitable relief. They are represented by attorneys Michael C. Nissim-Sabat and Jennifer S. Wagner of Mountain State Justice Inc. in Clarksburg.
