HUNTINGTON — A Kentucky bank is suing a borrower and guarantors, alleging breach of a business loan agreement.
Citizens Bank Kentucky filed a complaint April 17 in U.S. District Court for the Southern District of West Virginia Huntington Division against The Oaks LLC, Thomas A. Zamow and Joe C. Ferrell, alleging they failed to honor their obligations under the contract and owe nearly $300,000.
According to the complaint, on June 3, 2009, Citizens Bank provided a loan to defendants in the principal amount of $350,385. To date, the suit says, the principal balance of $289,927.84 remains due and owing.
The plaintiff alleges the defendants have failed and refused to make payments for the amount.
Citizens Bank Kentucky seeks trial by jury, judgment for $289,927.84, plus interest and all other charges pursuant to the contract, attorney fees and court costs, plus all other appropriate relief.
