HUNTINGTON — An electric company is suing a petrochemical business, alleging breach of a secured promissory note.
Nitro Electric Company Inc. filed a complaint April 20 in U.S. District Court for the Southern District of West Virginia Huntington Division against ALTIVIA Petrochemicals LLC, alleging the defendant breached its duty to comply with its obligation under the terms of the note.
According to the complaint, ALTIVIA agreed to assume Haverhill Chemicals LLC's liabilities, including its loan to the plaintiff. As of April 1, the suit says, the defendant is indebted to Nitro Electric for $251,540.90. The plaintiff alleges ALTIVIA has failed to make any payment of Haverhill's loan from Nitro.
Nitro Electric seeks trial by jury, all amounts owed, plus legal interest, court costs and expenses and all other just and proper relief. It is represented by attorneys Julia A.
