Beckley couple accuses Wells Fargo of breach of contract

BECKLEY — A Beckley couple is suing Wells Fargo, alleging breach of contract.

James G. Martin and Pamela Martin filed a complaint April 25 in Raleigh Circuit Court against Wells Fargo Bank NA, doing business as Wells Fargo Home Mortgage Inc., and Richard Pill, doing business as Pill & Pill PLLC, alleging failure to follow the required loss mitigation rules.

According to the complaint, the Martins suffered monetary damages because the defendants refused to accept the $5,000 from the Martins and to cancel a foreclosure sale.

The Martins seek trial by jury, actual and consequential damages, all legal fees and all other just relief. They are represented by attorney Gary M. Smith of Mountain State Justice, Inc. in Charleston.
