CHARLESTON — An estate administrator is suing a Harrison County long-term care provider, alleging negligence led to the injuries and death of a patient.
Dana Echard, individually and on behalf of the wrongful death beneficiary of Leslie Eubank, filed a complaint April 17 in Kanawha Circuit Court against West Virginia Veterans Nursing Facility, alleging wrongful death in failure to render services in a reasonably prudent manner.
According to the complaint, as a result of the nursing facility's negligence, Eubank died May 11, 2015, following chronic kidney disease. The suit says his wrongful death beneficiaries suffered loss of income, medical and funeral expenses and sorrow.
The plaintiff alleges the defendant failed to develop and implement an appropriate care plan to meet Eubank's needs and failed to ensure that he received proper diet, sanitary care and medications.
Echard seeks trial by jury, damages that will adequately compensatethe decedent's beneficiaries and all otehr equitable relief. She is represented by attorneys Edmund L. Wagoner and David E. Goddard of Goddard & Wagoner PLLC in Clarksburg,.
